First District Appellate Court Misconduct


Citizens of Illinois deserve honest, ethical, and competent Justices in the Appellate Courts of this State. However, some of the Justices do not meet this requirement.

Some of the First District Appellate Court Justices appear to be competing with each other to prove which Justice is more incompetent.

In past times, the Appellate Court's purpose was to correct errors in law issued by the trial courts; today the Appellate Court Justices issue Rule 23 unpublished orders that continue the errors of the trial court or they create their own errors of law.

And you, the Citizens of the State of Illinois, are paying these Appellate Justices with your tax dollars to violate the laws of the State of Illinois.

It is time for a change.

Incompetent Illinois judges must be removed from office, either by impeachment, or other effective means.


As one exemple, in case no. 1-97-0603, Bronstein v. State Farm Mutual Insurance Co., Justices Michael J. Gallagher, Robert Chapman Buckley, and Sheila M. O'Brien failed to comply with Code of Judicial Conduct Rule 62(A), which states " A judge should respect and comply with the law and should conduct himself or herself at all times in a manner that promotes public confidence in the integrity and impartiality of the judiciary."

Justices Michael J. Gallagher, Robert Chapman Buckley, and Sheila M. O'Brien apparently do not know, and do not comply with Supreme Court Rule 13(c)(2), relative to the proper and lawful procedure for an attorney to withdraw from representation of a client. The Rule requires that Notice of Withdrawal of the attorney shall be served upon the client by certified mail or by personal service. They allowed an attorney, John Thomas Moran, to withdraw without proper and legal service upon the client, Bronstein; then without notice, they issued an order, which by law is a void order. These Justices ignored the law and violated the due process rights of litigants before them.

Supreme Court Rules, as well as all court rules, are binding upon the court, as well as the litigant, and are the law of the State of Illinois. When any judge or justice does not comply with the law, the judge or justice performs an unlawful act. Judges have no lawful authority to perform an unlawful act. Judges have a duty to comply with the law; they do not have discretion to comply with the law only when they want to. These Justices have violated their oath of office.

Justices Michael J. Gallagher, Robert Chapman Buckley, and Sheila M. O'Brien have brought public disgrace to the Illinois judiciary.

Not only did the Justices fail to comply with the law, they knowingly, intentionally, and deliberately created a situation wherein they manipulated the judicial process and could control the outcome of the case.

Justices Michael J. Gallagher, Robert Chapman Buckley, and Sheila M. O'Brien knew that they had assisted an attorney in violating Illinois Rule of Professional Conduct Rule 1.16(d) (a Supreme Court Rule) in that the attorney and the judges had not taken reasonable steps to avoid foreseeable prejudice to the rights of the client. Justices Michael J. Gallagher, Robert Chapman Buckley, and Sheila M. O'Brien knew that Bronstein could not pursue his appeal without the documentation that his attorney had not delivered to him prior to his withdrawal. Justices Michael J. Gallagher, Robert Chapman Buckley, and Sheila M. O'Brien knew that a requisite before withdrawal is the delivery to the client of all documentation in the possession of the attorney that the client would require to pursue his appeal. Justices Michael J. Gallagher, Robert Chapman Buckley, and Sheila M. O'Brien engaged in connivance with an attorney to violate, and aided and abetted the violation of, a Rule of Professional Conduct.

Justices Michael J. Gallagher, Robert Chapman Buckley, and Sheila M. O'Brien further engaged in acts in violation of Code of Judicial Conduct Rule 63(B)(3) (a Supreme Court Rule). Justices Michael J. Gallagher, Robert Chapman Buckley, and Sheila M. O'Brien engaged in acts in violation of the laws of the State of Illinois.

Justices Michael J. Gallagher, Robert Chapman Buckley, and Sheila M. O'Brien issued a void order.

Justices Michael J. Gallagher, Robert Chapman Buckley, and Sheila M. O'Brien demonstrated their judicial ignorance and incompetence, and engaged in judicial misconduct.
