Article VI, clause 2 of the U.S. Constitution states that 'This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any state to the Contrary notwithstanding."

Article VI, clause 3 of the U.S. Constitution states that "The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution; but no religious Test shall ever be required as a Qualification to any Office or public Trust under the United States." [Emphasis added].

Under Article VI, clause 3, of the U.S. Constitution, every judge or government attorney takes an oath to support the U.S. Constitution. Whenever any judge or government attorney violates the Constitution in the course of performing his/her duties, then that judge or government attorney is acting without lawful authority, does not represent the government, has no lawful authority, and has no authority to issue a valid order. Acting without lawful authority, the judge has defrauded not only the Defendant, Debtor and/or the Plaintiff involved, but has also defrauded the government. The judge or the government attorney is paid to support the U.S. Constitution. By not supporting the Constitution, the judge or the government attorney is collecting monies for work not performed.

Court documents have been obtained that evidences the facts that Bankruptcy judge Manuel Barbosa has engaged in acts in violation of a debtor's First Amendment Rights and has engaged in acts in violation of a debtor's Fourteen Amendment Rights of Due Process. Further, as the trustee has committed fraud upon the court, such action has deprived judge Manuel Barbosa of jurisdiction.

The U.S. Supreme Court has recognized that such a situation can occur, where a judge violates the U.S. Constitution and no longer has lawful authority to issue any valid judicial orders. Under the Supreme Law of the Land, such judge not only has no lawful authority to act, such judge also has no immunity from lawsuit, as the judge is acting not in a judicial capacity, but acting in his/her person. The U.S. Supreme Court has also ruled that such judge is engaged in treason.

Bankruptcy judge Manuel Barbosa is such a judge.

judge Barbosa, what about the U.S. Constitution do you not understand?

At the current time, our soldiers are dying in Iraq to support the U.S. Constitution. And what do you do? You make a mockery of the Constitution by your failure to support the Constitution.



On April 8, 2003, judge Manuel Barbosa issued a void order in an attempt to deprive a debtor of her Constitutional Right to Petition the Court for Redress, an essential element of one of her First Amendment Constitutional Rights.

It is interesting to note that attorney Bernard J. Natale prepared the order. As an attorney, Mr. Natale also took an oath of office to support the U.S. Constitution. Apparently, judge Manuel Barbosa and attorney Bernard J. Natale have conspired together to violate their oaths to support the U.S. Constitution.

This debtor attempted to filed her Motion to Vacate the Unconstitutional order, but the clerk would not accept her filing. Since the original order was issued in violation of the First Amendment Constitutional Rights of the debtor, the order is void as a matter of law.

Should we now add the name of Barbosa to the list of Hitler, Stalin, and Saddam Hussein as persons who violated Human Rights?



Apparently this is not the first time that judge Manuel Barbosa violated a debtor's Constitutional Right. On March 10, 1999, judge Barbosa issued an order which violated another debtor's First Amendment Rights to Petition the Courts for Redress. It appears that when judge Manuel Barbosa cannot intimidate Debtors and when he does not have the law on his side, he cuts off discussion in his courtroom by issuing unlawful gag orders in violation of the U.S. Constitution.

Following is what can be found in a search of records relative to judge Manuel Barbosa:

"The actions and statements of the Bankruptcy Trustee appear to be designed to protect Bankruptcy Judge Manuel Barbosa from the consequences of his actions.  The public record indicates that Manuel Barbosa had absolutely no judiciary experience on either side of the bench from the time he graduated from John Marshall Law School in 1977 until he was "appointed" to the Federal Bench in March of 1998.  The public record indicates that Manuel
Barbosa was not "appointed" to his present position on the basis of merit or his previous judiciary experience or record.

Maybe because of his lack of judiciary experience or maybe because of a resulting incompetence or maybe because of the effect of a malign influence upon him or involving him, Judge Barbosa is now responsible for, and involved in, a fraudulent transfer of title to the property in question that has occurred under the color of the authority of the United States
Bankruptcy Court for the Northern District of Illinois, Western Division.

Judge Manuel Barbosa and the Bankruptcy Trustee have also unlawfully confiscated rent money from the property in question, which is obviously not a part of the Debtor's bankruptcy estate, as a part of their collective effort to induce or intimidate the judicially determined owner of that property into validating their fraudulent transfer of title.  Those efforts have been unsuccessful and will continue to be unsuccessful.

The Bankruptcy Trustee, the Bankruptcy Court, the District Court and this Court are required to administer justice according to rules and clearly established law rather than according to the whims of vested interests or the practice of criminal activity."

Have the actions of judge Manuel Barbosa impugned the integrity of the Federal judiciary?
