On January 26, 2002 CLR received a threatening letter dated January 24, 2002 from the law firm of Davis, Matthews & Quigley, P.C., a copy of which can be found here.

IOHO, apparently the attorneys for the law firm of Davis, Matthews & Quigley, P.C. have a problem similar to that
of other attorneys, in that they have a problem reading,
comprehending what they have read, or making misleading
statements. The attorneys for the law firm of Davis, Matthews & Quigley, P.C. apparently only read the first clause on
the State of Georgia web-page, and ignored the rest of the
paragraph.

Courts have ruled that fraud as it applies to attorneys is any
attempt to deceive, whether by commission, by omission, by
silence, by gesture, or by innuendo. The attorneys for the law firm of Davis, Matthews & Quigley, P.C. should know the definition of fraud by an attorney. Have the attorneys for the law firm of Davis, Matthews & Quigley, P.C. acted fraudulently in any of their communications either with a respondent, with a complainant, with a client, or in court? We understand that they may not have been forthcoming in all of their  communications, and in fact in our opinion have engaged in misleading in some of their communications. As only one example, the above referenced letter from the attorneys of the law firm of Davis, Matthews & Quigley, P.C. to CLR dated January 24, 2002.

At no time did we state that the law firm of Davis, Matthews & Quigley, P.C. was disciplined by a state disciplinary agency. We did report however that an attorney at Davis, Matthews & Quigley, P.C. had been sued for legal malpractice.

Have the attorneys for the law firm of Davis, Matthews & Quigley, P.C. been truthful in all of their dealings with, and have not mislead any of, their clients at any time?

Have all of the attorneys at Davis, Matthews & Quigley, P.C. engaged in a conspiracy to commit fraud or to fail to report the misconduct of other attorneys at the law firm of Davis, Matthews & Quigley, P.C.?

Isn't it unethical for officers of the court to threaten any person in any communication, whether written or oral? Is not your threatening letter of January 24, 2002 to us engaging in an act of misconduct? Have the attorneys at Davis, Matthews & Quigley, P.C. not engaged in mail fraud? Have the attorneys at Davis, Matthews & Quigley, P.C. now not brought disrepute to the legal establishment?

Isn't it unethical to attempt to interfere with anyone's
Constitutional Rights?

Please also provide us with a full and complete list of the
names, last known addresses and phone numbers of all of your
clients, both past and present. As you know, lists of clients
have been held by the courts to be business records, and
therefore are not within the client-attorney privilege
exemption from disclosure.

Please provide the above along with your affidavit that your
submissions are accurate, full and complete.  Upon receipt of
the above, our Review Board will review your documentations and
investigate your allegations to determine whether or not you
have brought disrepute to the legal establishment.  If our Review Board finds that you have not brought disrepute to the legal establishment, then your name will be removed from our web-site.

We understand that in most states, the misconduct of one
attorney in a law firm is considered the misconduct of all attorneys in the firm. We also understand that each and every member of a law firm has a separate and individual duty to report the misconduct of other attorneys to the attorney disciplinary agency. Should an attorney not report the misconduct of another attorney, then that attorney is engaged in misconduct.

Do you honestly believe that a jury, after reviewing all of the evidence, will find that in the opinion of the public, you have not brought disrepute to the legal establishment?
