On November 19, 2001 Sperry wrote a letter to Judge Fabian, had it filed-stamped with the Clerk of the Circuit Court of Kane County so that it would be part of the record of the case should there be any reason to file an appeal, and the file-stamped letter was hand-delivered to Judge Fabian and Chief Judge Wegner.

On November 20, 2001 Sperry did not appear in court, as per his November 19, 2001 letter, but did have his court reporter present to record what occurred in court. In addition he had his court observers present. Finally on November 23, 2001, Sperry received by mail a void order issued by Judge Fabian.

In his November 27, 2001 letter addressed to Judge Fabian, filed with the Clerk of the Circuit Court and file-stamped was served personally upon Judge Fabian and Chief Judge Wegner.
