Illinois Supreme Court Rule 721(d) states that: "The articles of incorporation or association or organization shall provide, and the shareholders of the corporation or members of the association or limited liability company shall be deemed to agree by virtue of becoming shareholders or members, that all shareholders or members shall be jointly and severally liable for the acts, errors and omissions of the shareholders or members and other employees of the corporation or association or limited liability company arising out of the performance of professional services by the corporation or association or limited liability company while they are shareholders or members."

As CLR understands the above SCR, as shareholders in Gabe, Gabe & Associates, P.C., attorney Allen S. Gabe is equally responsible for the acts of attorney Caryl Jacobs Gabe for any misconduct she has been charged with, and attorney Caryl Jacobs Gabe is equally responsible for any acts of misconduct of attorney Allen S. Gabe.

Since attorney Caryl Jacobs Gabe was disciplined for acts of misconduct directly attributable to her, attorney Allen S. Gabe was also involved in the same misconduct, during the time that they were shareholders in Gabe, Gabe & Associates, P.C.
