DECLARATION OF RICHARD PRAZENKA
I, Richard Prazenka, declare as follows:
1. I was a visitor to the court hearing on March 12, 1996 in the above titled cause, before Judge James, of the United States Bankruptcy Court, Northern District of Illinois, Eastern Division.
2. I am not a party to this case, nor am I a relative to any party in this matter, nor an employer of any party, nor an employee of any party to this case.
3. Relative to this case, I am a detached and reasonable observer of the actions in that court of that date.
4. Judge James appeared to have concluded how he would adjudicate the hearing for Eugene Alpern before he held the hearing.
5. Judge James arbitrarily raised the bond required for Eugene Alpern from $180,000. to $200,000. Without allowing presentation of any formal evidence or appraisal to establish the true liability of Mr. Alpern.
6. In view of the serious matter of removing Mr. Alpern from his home, Judge James invoked the order in a such a way to give himself pleasure.
7. If called as a witness, I could competently testify to the foregoing.
