                        Re: Case no. 93-7643
                               In re Eugene Alpern

Dear Judge Schmetterer:

After my court hearing yesterday, I went to the Clerk of the Bankruptcy Court's office to inquire how one obtains information on in forma pauperis status. The Deputy Clerk informed me that I had to obtain such information through the Judge of the case. Upon inquiry about a form for such a Motion, I was again informed to obtain it from the Judge of the case.

I returned to your courtroom immediately thereafter, and observed the last case of that call. That Debtor was also acting in proper persona and your honor complied with the law in instructing him on what he had to do to present his motions and affidavits for his next hearing. Even though I had filed in this court a "Memorandum on Some of the Court's Duties Towards Non-represented Litigants", this court failed at all times to comply with the law relative to me.

Upon the conclusion of his case, I requested permission to approach the bench, to inquire about in forma pauperis status, and the court's failure to comply with the law relative to my in proper persona status. Your Honor denied me such permission to approach the bench, and in effect denied me my legal, civil, and Constitutional Rights. I believe your action was deliberate, intentional, and knowing.

Your personal bias, prejudice, and your appearance of partiality towards me has been noted, and I suggest that, according to the Supreme Law of this Land and of this Circuit, you have disqualified yourself from this case.

Yours truly,

Eugene W. Alpern
