EUGENE WALTER ALPERN, being duly sworn, states as follows:
1. I am the Debtor in this action.
2. That the Debtor reviewed the computer docket of the Clerk of the Bankruptcy Court on December 5, 1995 and could not find any reference to any document of a Notice of Motion, Certificate of Service, or Motion relative to the purported Order dated November 27, 1995.
3 That the Debtor found no document in the Court file that was a Notice of Motion, Certificate of Service, or Motion filed since July 27, 1995 and prior to the purported Order of November 27, 1995.
4. That the Debtor, together with attorney Mack P. Manning, reviewed the computer docket of the Clerk of the Bankruptcy Court and the court file on December 15, 1995. On that date neither the Debtor nor attorney Manning could find any reference to a Notice of Motion, Certificate of Service, or any Motion filed relative to the purported Order of November 27, 1995 in the computer docket or in the court file.
5. That the Debtor has never received a Notice of Motion, Certificate of Service, or any Motion relative to any hearing on November 27, 1995.
