Re: IRMO Kost v. Kost, 94-D-1500
This morning I had the privilege, along with other court observers, to observe Judge Terence M. Sheen in his court.
I wish to call attention to the following in the Kost case:
(1) Judge Sheen issued an order authorizing the payment of opposing counsel fees from child-support payments,
(2) at no time had Judge Sheen ever appointed a GAL to protect the interests of the children,
(3) Judge Sheen issued an order today based on a Petition to Modify a Final Judgment, a final judgment which was issued over 30 days ago. The Petition was heard today but was served without proper legal service by either certified mail or by personal service. It is our understanding that a Petition to Modify a Judgment is a new proceeding and requires proper legal service by certified mail or by personal service. It is our understanding that all orders issued without proper legal service are void ab initio.
Since Judge Sheen is within your supervisory authority, and since you have previously been informed of Judge Sheen's actions without jurisdiction at any time, we believe that you have a duty to supervise him and see that the law is followed by judges in your circuit.
Any inspection of the record of case no. 94-D-1500, Kost v. Kost, impeaches any claim that the court ever held subject-matter jurisdiction in this case. Judge Sheen's rulings make a mockery of the Supreme Court's rulings.
