DuPage County

Dear Judge Sheen:

                Re: IRMO KOST 94-D-1500

Our organization has been monitoring certain judges in DuPage County.

The purported Petition for Dissolution of Marriage filed on behalf of Robert Kost by the law firm of Mirabella & Kincaid, P.C. on June 14, 1994 was filed by a law firm which is prohibited to practice law or to maintain an office in this state.

Supreme Court Rule 721(c) (1994) states: "No corporation or association shall engage in the practice of law in Illinois, or open or maintain an establishment for that purpose in Illinois, without a certificate of registration issued by this court."

We are enclosing a copy of a letter dated October 9, 1998 from the Supreme Court of Illinois, which states, in pertinent part: "Our records indicate that Mirabella & Kincaid, P.C. is not registered with the Supreme Court as a professional corporation pursuant to Supreme Court Rule 721."

Since according to Supreme Court Rule 721(c), Mirabella & Kincaid, P.C. cannot practice law in Illinois, the purported Petition filed by them in the above cited action violates Illinois law, and does not confer any subject-matter jurisdiction upon the Circuit Court of the 18th Judicial Circuit.

Since the representation and filing of a Petition by a law firm that is prohibited from practicing law does not lawfully confer subject-matter jurisdiction upon this court, will you be immediately sua sponte vacating all of the void ab initio judgment and orders issued in the Kost matter?

Yours truly,

Tom Howard
