Dear Judge Sheen:

                Re: IRMO Kost v. Kost, 94-D-1500

As a court observer on October 20, 1998 we observed that you were informed by Mrs. LuAnn Kost that she had not received a copy of the ex-parte letter you received from Mr. Robert Kost. (See your letter to Mr. Kost dated October 16, 1998, a copy of which was carbon copied to Mrs. LuAnn Kost).

Mrs. Kost has informed us that as of November 5, 1998 she has not received the copy of the ex-parte letter you received from Mr. Kost that you stated in open court on October 20, 1998 that you would send to her.

We presume that you are familiar with Supreme Court Rule 63(A)(4) [Code of Judicial Conduct] that a "judge shall not initiate, permit, or consider ex parte communications, or consider other communications made to the judge outside the presence of the parties concerning a pending or impending proceeding ... ". We suggest that you have been in violation of this Supreme Court Rule (SCR), as well as of other SCR's.

Further we have affidavits from court observers relative to your expressing your continuing bias and prejudice in this case. These affidavits will be published for the public to better understand how you operate your court in violation of the law.
