I, Rob Shore, hereby certify the following to be true and correct:
I am a newsmedia reporter.
1. On November 14, 1996, at the request of Paul Szablowski, I went with him to Room 802, Richard J. Daley Center for the purpose of reviewing the court file in case no. 94-D-11666, Christine Szablowski v. Paul Szablowski. Upon inspection of the file, it was noticed that the Petition for Dissolution of Marriage had not been lawfully verified. Mr. Szablowski then ordered and received a certified copy of the Petition.
2. On August 5, 1998 I witnessed a hearing that was scheduled in case no. 94-D-11666, Christine Szablowski v. Paul Szablowski. During that hearing Judge Sullivan ordered the bailiff to take Mr. Szablowski into detention and place him in an adjoining room.
3. Later that morning, during a break in the court call, I met with Judge Daniel Sullivan and informed him that a certified copy of the Petition for Dissolution of Marriage filed in case no. 94-D-11666, Christine Szablowski v. Paul Szablowski, was never lawfully verified. At that time I pointed out to him that since the Petition was not lawfully verified, the court had no jurisdiction. Judge Sullivan agreed with me. He further stated, and I paraphrase, "Those attorneys, they can get sued for that."
4. Judge Sullivan shortly thereafter that morning called the court to session, and ordered the bailiff to release Mr. Szablowski from detention in the side room and bring him before the court.
5. Judge Sullivan then ordered Mr. Szablowski to mail a second copy of his "RESPONDENT'S MOTION DEMANDING PETITIONER PROVE THAT THE 94-D-11666 TRIAL COURT HELD SUBJECT-MATTER JURISDICTION AND FOR OTHER RELIEF" to the Petitioner and to the Guardian ad Litem.
6. Judge Daniel Sullivan has known since August 5, 1998 that a valid Petition for Dissolution of Marriage had never been filed in case no. 94-D-11666, Christine Szablowski v. Paul Szablowski.
7. Several days later, I again met with Judge Daniel J. Sullivan and showed him a certified copy of the Petition for Dissolution of Marriage in case no. 94-D-11666, Christine Szablowski v. Paul Szablowski which was not lawfully verified. [Exhibit A]. I pointed out to Judge Sullivan that the Petition had never been properly notarized, as the notary's signature was missing. Judge Sullivan acknowledged that without a properly verified Petition, the Petition was defective, and conferred no jurisdiction upon the court.
8. At the court hearing on September 16, 1998, Judge Sullivan stated that the court file was incomplete, and since he had no court reporter at that hearing, he would continue the hearing until December 2, 1998 to give the clerk additional time to restore the file.
9. On December 2, 1998, Judge Sullivan held a sham court hearing. He stated that the file was still incomplete. He had previously determined the ruling he would issue that day, and to this effect, he had five bailiffs in the court room. There is no reason for any bailiffs beyond what is normally in his courtroom, unless he had predetermined the outcome of the case and he expected a problem with his ruling, his ruling being contrary to law. Judge Sullivan knew, since August 5, 1998 that he had no jurisdiction in this case.
10. During the hearing on December 2, 1998 Judge Sullivan was observed winking repeatedly at attorney Myron Greenbaum. It is this affiant's impression that Judge Sullivan was signaling Greenbaum that he would rule in Greenbaum's favor.
11. Judge Sullivan knew, and had admitted on August 5, 1998, that without a valid Petition in the record of the case, he never held any jurisdiction in this proceeding.
