Judge William R. Penn

In 1999, Judge William R. Penn, of the Circuit Court of Will County, Illinois, demonstrated his incompetence in the law when he violated the U.S. Constitution.

To become a judge, a person takes an oath to support the Constitution of both the United States and of the State of Illinois. When a judge violates that oath, he/she wars against the government; he acts not as a judge, but as a private person. The judge's orders are void, of no legal force or effect.

Judge Penn issued an order in case no. 99-CH-618, The Will County Board v. Kathleen Konicki, which violated Ms. Konicki's First Amendment Constitutional Rights. Judge Penn, as well as many other judges, believe that they can issue a gag order upon any person in an attempt to prevent that person from speaking upon a certain issue. But no judge has lawful authority to do such, except in certain special circumstances. These judges, as well as Judge Penn, either do not know the law or they have a complete disregard for the law. In December 1999, the Illinois Third District Court, in appellate case no. 3-99-0533 found that Judge Penn violated Ms. Konicki's First Amendment Constitutional Right, and vacated Judge Penn's void order. The Appellate Court found that Judge Penn had "imposed an unconstitutional prior restraint on Konicki's first amendment rights".
